To ensure further assistance in case of an emergency while traveling abroad, the U.S. Government provides the Smart Traveler Enrollment Program (STEP) as a free service to U.S. citizens. Registration with STEP is recommended for travelers or citizens residing in foreign countries, as it allows the Department of State to better assist you in case of any emergencies during your travels.

BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, WE DO NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS, OR, IN FACT, TO ANY DESTINATION. YOUR PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT YOUR OWN RISK.

AGREEMENTS REGARDING ACCURACY, FINANCIAL RESPONSIBILITY, AND THIRD-PARTY SUPPLIERS

By making travel bookings with us, whether through our website or any other means, you warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement. You also acknowledge that you have the authority to make travel bookings in accordance with all the terms and conditions outlined herein. Additionally, you assume financial responsibility for all your travel bookings and any usage of your account by others, including minors living with you.

Furthermore, you warrant that all the information provided by you or members of your household during transactions with SEA FREEDOM VACATIONS is true and accurate. Please refrain from engaging in speculative, false, or fraudulent reservations, as well as reservations made in anticipation of demand, as such actions are strictly prohibited.

It is essential to understand that separate terms and conditions will apply to your reservations and purchases of travel-related goods and services from selected suppliers. When dealing with SEA FREEDOM VACATIONS and its partner suppliers, you agree to comply with their respective terms and conditions of purchase. This includes timely payment of all amounts due and adherence to the supplier’s rules and restrictions regarding the availability and use of fares, products, or services.

Be aware that any violation of a supplier’s conditions of purchase may result in the cancellation of your reservation(s) or purchase(s), denial of access to flights, hotels, cruises, or automobiles, forfeiture of any payments made for such reservation(s) or purchase(s), and potential debiting of your account by SEA FREEDOM VACATIONS to cover any costs incurred as a result of the violation.

Ultimately, you are fully responsible for all charges, fees, duties, taxes, and assessments arising from your travel bookings made through access provided by SEA FREEDOM VACATIONS. Please ensure compliance with these terms and conditions to ensure a smooth and enjoyable travel experience.

CHANGES TO CONFIRMED BOOKINGS

If you wish to modify any part of your confirmed arrangements before your trip or during your travels, we will make an effort to assist you. However, please be aware that certain bookings may not be eligible for changes. Administrative charges of $25 or more per change, per person, will apply. These charges will be communicated to you at the time of booking and will be provided again upon confirmation, taking into account the specific circumstances of your request. To initiate any desired changes, please submit your request to us in writing.

LIMITATIONS OF OUR RESPONSIBILITY

We act as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors that offer accommodations, transportation, and/or other services (referred to as “supplier(s)”). Please note that SEA FREEDOM VACATIONS is not the source or provider of the travel services itself. Each of these supplier companies operates independently, with its own management, and is not under the control of SEA FREEDOM VACATIONS.

When you see the names of these suppliers in your travel documentation, it indicates that they are the entities responsible for providing the travel services you have purchased. By booking with us, you consent to using these suppliers, and you should be aware that each supplier has its own specific Terms and Conditions, which are provided in printed form and can be found on their respective websites. These Terms and Conditions govern the transactions you have with them.

It is important to acknowledge that all bookings made with SEA FREEDOM VACATIONS are accepted on behalf of the travel suppliers mentioned in your itinerary. The transportation, accommodations, and other services provided by these operators and suppliers are subject to the terms and conditions specified in the tickets, exchange orders, or vouchers issued by them and/or their suppliers. You should review and understand these terms, including any conditions mentioned on their respective websites.

BECAUSE SEA FREEDOM VACATIONS ACTS AS AN AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS, AND DOES NOT HAVE CONTROL OVER THEIR OPERATIONS, WE WANT TO MAKE IT CLEAR THAT WE ARE NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE THAT MAY ARISE FROM THESE SERVICES. WE HEREBY DISCLAIM ANY LIABILITY, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL, OR INDIRECT DAMAGES, IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKED THROUGH SEA FREEDOM VACATIONS’ OFFICE OR WEBSITE. THIS INCLUDES ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY, OR IRREGULARITY THAT MAY OCCUR DUE TO THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS, OR OTHERWISE OF THE SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES. THIS ALSO COVERS ANY FAILURE TO DELIVER OR PARTIAL/INADEQUATE DELIVERY OF SERVICES, FUEL INCREASES, AND OTHER MATTERS BEYOND SEA FREEDOM VACATIONS’ CONTROL. YOU AGREE TO RELEASE SEA FREEDOM VACATIONS FROM ANY LIABILITY IN THIS REGARD.

Please be aware that certain circumstances, such as weather conditions, volcanic eruptions, ash clouds, and wind, are beyond our control and cannot be guaranteed to occur or not occur. In such cases, SEA FREEDOM VACATIONS is not responsible for the resulting disruptions or any adverse effects.

We retain the right to cancel or alter any itinerary, and we may refuse to accept or retain any person on a tour at any time. While we strive to provide accurate schedules, we cannot assume responsibility for any air and/or ground schedule changes. Our suppliers retain the same right in their terms and conditions.

ALTERATIONS IN TRAVEL PLANS

Alterations in itinerary may be necessitated for any number of reasons, including but not limited to severe weather at our sole discretion and subject to supplier terms and conditions. If a property, supplier, activity, or area is deleted for any reason, it may be replaced with a comparable one if available.

Lastly, please note that SEA FREEDOM VACATIONS has received commission and fees for travel transactions. Any recovery from SEA FREEDOM VACATIONS will be limited to the commission and fees actually received from the Customer.

TRAVEL INSURANCE

SEA FREEDOM VACATIONS offers a range of optional products and services to enhance your travel experience. One such option is travel insurance, which provides valuable protection for passengers and their investments. Please note that unless specifically stated otherwise, travel insurance is not automatically included in the cost of your itinerary. It is designed to safeguard you against various risks, such as third-party supplier default/bankruptcy protection, travel delays, interruptions, missed cruise connections, cancellations, medical emergencies requiring transportation or evacuation, repatriation, lost luggage and baggage delays, illness, job loss protection, change of plans, accidental death, disability, travel accident/sickness medical expenses, and more.

HAVING PROPER TRAVEL INSURANCE CAN BE CRUCIAL, AS IT MAY HELP YOU AVOID FINANCIAL LOSSES IN ALMOST ANY SITUATION. WITHOUT APPROPRIATE TRAVEL INSURANCE, PLEASE UNDERSTAND AND AGREE THAT IF YOU CHOOSE TO CANCEL OR INTERRUPT YOUR TRAVEL FOR ANY REASON, CERTAIN PORTIONS OF THE TRIP OR TOUR MAY NOT BE REFUNDABLE, AND BOTH SEA FREEDOM VACATIONS AND THE TRAVEL SUPPLIERS’ CANCELLATION PENALTIES WILL APPLY. THIS COULD RESULT IN THE LOSS OF MONIES UP TO THE FULL COST OF YOUR TRAVEL BOOKING AND RELATED EXPENSES.

WHILE THE PURCHASE OF TRAVEL INSURANCE IS NOT MANDATORY FOR ACQUIRING OTHER PRODUCTS OR SERVICES OFFERED BY SEA FREEDOM VACATIONS, IT IS HIGHLY RECOMMENDED TO CONSIDER ITS BENEFITS. HOWEVER, PLEASE BE AWARE THAT EMPLOYEES OF SEA FREEDOM VACATIONS ARE NOT QUALIFIED OR AUTHORIZED TO PROVIDE TECHNICAL INFORMATION ABOUT THE INSURANCE’S BENEFITS, EXCLUSIONS, AND CONDITIONS OR ASSESS THE ADEQUACY OF YOUR EXISTING INSURANCE COVERAGE.

Should you choose to opt for travel insurance, an additional charge will apply based on the coverage you select. We encourage you to carefully review the insurance options available and consider your travel needs to make an informed decision that best suits your preferences and requirements.

FORCE MAJEURE

“Force Majeure” refers to circumstances beyond the reasonable control of Sea Freedom Vacations, including but not limited to acts of God, explosions, floods, tempests, forceful winds, fires, accidents, wars or threats of war (declared or undeclared), acts of terrorism, sabotage, insurrections, riots, strikes, civil disturbances, requisitions, sickness, quarantine, government interventions, adverse weather conditions, defects in machinery and vehicles, delays, wildlife, or other untoward occurrences.

In the event of any delay in performance or non-performance of its obligations due to Force Majeure, Sea Freedom Vacations shall not be considered in breach of these terms and conditions, and it shall not be liable to you for such delay or non-performance. IT IS HIGHLY RECOMMENDED TO PURCHASE TRAVEL INSURANCE FOR ALL TRIPS.

If Force Majeure affects Sea Freedom Vacations or any of its travel suppliers, they have the right, at their sole and absolute discretion, to modify or cancel any itinerary or arrangement related to the trip. Any refund issued by Sea Freedom Vacations to you due to non-performance of obligations shall be determined at its sole and absolute discretion, with reasonable efforts made to reimburse you where possible. However, Sea Freedom Vacations reserves the right to deduct from any refund recoverable the reasonable actual and potential costs incurred by Sea Freedom Vacations as a result of the Force Majeure and applicable cancellation fees.

Regarding civil unrest, once Sea Freedom Vacations has conducted an investigation into the prevailing situation, it shall, at its discretion, decide whether to proceed with the trip. In such circumstances, you may choose to cancel the trip subject to the terms and conditions set forth by Sea Freedom Vacations and each individual supplier.

CONSENT TO USE OF YOUR PHOTO OR VIDEO IMAGE

Sea Freedom Vacations and our third-party suppliers retain the right to utilize any photograph or video captured at any event or during any travel activity, without seeking express written permission from those included in the photograph or video and without compensation. These images may be used by us or our suppliers in various publications or other media materials produced, used, or contracted by the party using the material. Such materials may include, but are not limited to, brochures, invitations, books, newspapers, magazines, television, websites, and more.

Should you wish to decline being photographed or having your image distributed, you just communicate your intentions in writing to Sky+Sea, LLC d/b/a Sea Freedom Vacations at the following address: 4601 East Douglas Avenue, Suite 150, Wichita, KS 67218, along with a photograph for identification purposes. We can only control our usage; refer to Terms and Conditions of the respective suppliers for notification procedures.

RESERVATION OF RIGHTS, CHANGES TO THESE TERMS

We retain the right to modify these Terms at any time. Updated versions of the Terms will be made available on our website and will take effect immediately upon posting. To stay informed about any changes, you should check this website regularly. By using the website or any other of our services after any modifications to the Terms, you signify your consent to the updated terms.

LIMITED ACCESS TO PASSWORD PROTECTED/SECURED AREAS

Access to password protected and/or secure areas of this website is strictly limited to authorized users. Unauthorized individuals attempting to gain access to these areas may face legal prosecution.

RIGHT TO RECTIFY ERRORS/OFFERS SUBJECT TO AVAILABILITY

The laws of the State of Kansas, USA, govern these Terms and Conditions for travel bookings made with Sea Freedom Vacations, including the use of the Sea Freedom Vacations website. You hereby consent to the exclusive jurisdiction and venue of the courts of Sedgwick County, Kansas, USA, in all disputes arising out of or related to travel bookings with Sea Freedom Vacations and the use of our website. Please be advised that the use of the Sea Freedom Vacations website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including this paragraph.

If any part of these Terms and Conditions is found to be invalid or unenforceable in accordance with applicable law, including the warranty disclaimers and liability limitations stated above, the invalid or unenforceable provision will be deemed superseded by a valid and enforceable provision that closely aligns with the original intent, and the agreement shall continue to be effective.

These Terms and Conditions, along with any other referenced terms and conditions, constitute the entire agreement between the Customer and Sea Freedom Vacations concerning travel bookings made through any means of accessing information, including the Sea Freedom Vacations website. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the Customer and Sea Freedom Vacations regarding communications with Sea Freedom Vacations, including its website. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings related to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

All rights not expressly granted herein are reserved. This agreement may be signed in counterparts, the counterparts together being construed as a single document.
